In the previous case, Nichia filed a lawsuit against the local lawsuit in Dusseldorf, Germany, invoking Hongqi Technology for patent infringement. The case number is 4a O 236/10. The Dusseldorf Appeals Court in Germany does not allow Hongqi Technology to appeal again. However, Hongqi Technology can still request an appeal from the Federal Supreme Court.
In addition, Nichia said that the company filed a German distributor EBV Elektronik GmbH & Co. KG and EBV Management GmbH (collectively "EBV") at the District Court in Dusseldorf, Germany on February 22, 2017. Infringement of patent litigation.
According to Nichia's claim, in this lawsuit, the white LED product "XI3535-KT577J1-03201-000P" manufactured by LED manufacturer Yiguang Electronics Co., Ltd. in Taiwan and distributed by EBV in Germany infringed YAG of Nichia. Patent (EU No. EP 0 936 682, German corresponding number DE 697 02 929). Therefore, Japan and Asia asked the German District Court of Dusseldorf to issue a permanent injunction against EBV, order it to file books, recycle and destroy the aforementioned products, and request damages.
Nichia still reiterates that it will spare no effort to seek to protect its patents and other intellectual property rights, and to take legal action against infringers in any country, as appropriate and necessary.
